Notarizing U.S. documents from Italy: heirs, families and signers in Milan or Rome

In Italy and asked to sign a U.S. estate document, affidavit or consent? Compare a U.S. consulate, an Italian notaio and remote online notarization, and see how families with several signers in different countries keep the file moving.

If you are in Italy and a U.S. attorney, bank or court asks for your notarized signature, you can usually choose between a U.S. consular appointment, an Italian notaio, or remote online notarization with a U.S. commissioned notary by video. The U.S. recipient decides which it accepts, so get its written instructions first.

Many requests from Italy are family files with several signers in Italy, the United States and elsewhere. This guide covers the U.S. side and the logistics; for Italian law, ask a professional in Italy.

Typical situations for signers in Italy

  • Heirs of a relative who lived in the United States. A cousin in Milan or a sibling in Bari is named in a U.S. estate. The probate attorney sends an affidavit of heirship, a waiver, a receipt and release, or a consent to the appointment of an administrator.
  • Dual citizens and Italian Americans in Italy. They still own a New Jersey house or a New York account and must sign a deed, account form or power of attorney.
  • Families coordinating care. A son in Turin signs a health care proxy acknowledgment so a sister in the United States can manage a parent's affairs.

The attorney drafts the content. Your part is to sign the right version, in the right way, on time.

When several family members must sign

Estate files usually stall on coordination, not on one signer. One heir signs at a consulate, another before a notary in Ohio, and the attorney receives three formats on three dates. A few habits help:

  1. Ask whether each heir can sign a separate copy (counterparts) or everyone must sign the same original.
  2. Agree on one route per signer and share it with the attorney before anyone signs.
  3. Use the exact version the attorney sent, not an older draft or one a relative forwarded.
  4. Keep a scan of each signed page and send it to the attorney as soon as the original leaves.

Option 1: the U.S. Embassy or a U.S. consulate

The U.S. Embassy in Rome and the U.S. consulates in Milan, Florence and Naples offer notarial services by appointment for documents meant for the United States. U.S. courts, banks and attorneys widely recognize consular notarization, so it suits strict recipients and court filings.

The limits are availability, travel to the hosting city, and bringing the unsigned document and your passport. Check the embassy website for which posts offer notarial appointments.

Option 2: an Italian notaio

An Italian notaio is a legally trained public official, a role well beyond a U.S. notary public. Many can authenticate a signature on an English document, but the result is an Italian notarial act, often with Italian wording added. Some U.S. recipients accept it as is; others ask for additional certification.

Ask the U.S. attorney which certification is needed, and the notaio's office about Italian formalities. This route suits recipients who want a paper original and accept foreign notarization.

Option 3: remote online notarization

With remote online notarization, a U.S. commissioned notary notarizes your signature during a recorded video session. You confirm identity with your passport, sign electronically, and the attorney receives a secure file right away. Heirs in different countries can sign the same week without travelling.

The remote notarization service for signers abroad confirms acceptance with the recipient first and schedules a session around your day in Italy. Some probate courts and recorders insist on paper, so ask first. If a power of attorney will also be used outside the United States, the guide on apostilles for a power of attorney explains that separate step.

When the attorney needs a paper original

For a wet ink original signed in Italy: print the final version, sign only in front of the notary, scan every page, then ship by tracked courier and send the tracking number to the attorney the same day. Italian A4 paper differs from U.S. Letter; most recipients accept either, but ask if the document will be recorded.

The print, sign, scan and mail service handles printing and the scanned record; international mailing covers tracked shipping between Italy and the United States, including return envelopes for several originals.

Practical points for signers in Italy

  • Names. Many married women in Italy hold passports in their birth surname while U.S. records show a married name. Tell the attorney which name your passport shows before signing.
  • Time zones. Italy is usually six hours ahead of the U.S. East Coast, so an afternoon session there reaches U.S. offices in the morning.
  • Identity. A valid passport is the most practical ID for a U.S. remote session.
  • Language. The notary confirms you are signing willingly and understand that you are signing. If English is difficult, say so before the session.

For what a document means, such as a waiver's effect on your share of an estate, speak with the U.S. attorney or your own counsel. Notarization confirms who signed, not what the document does.

How TR Signing Group handles it

TR Signing Group reads the attorney's instructions, confirms the route for each signer and tracks who has signed what. When remote online notarization is accepted, Tanim Raquib, a commissioned New Jersey notary public, holds the session at a time that works in Italy through the international signer service, and can do the same for relatives elsewhere. When originals are required, TRSG coordinates printing, signing and tracked shipping. Request a quote or book a free 15-minute call to map out your family's file.

FAQ

Questions we hear often

I am an heir living in Italy. Do I have to travel to the United States to sign?

Usually not. A U.S. consulate, an Italian notaio or remote online notarization can often work, depending on what the attorney and court accept.

Can several heirs in different countries sign separately?

Often yes, on separate copies called counterparts, if the attorney agrees. Ask before anyone signs.

Will a U.S. attorney accept a signature authenticated by an Italian notaio?

Some will, some ask for additional certification, and courts may have their own rules. Get the attorney's answer in writing.

My passport shows my birth surname but the U.S. papers use my married name. What should I do?

Tell the attorney before the session. They decide how to handle the difference, and the notary relies on your passport.

Can TRSG explain what the estate document means for me?

No. The U.S. attorney or your own counsel explains the substance. TRSG handles the signing, notarization and logistics.
